Notice of Privacy Practices (HIPAA)

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

As a Licensed Professional Counselor, Jerrica Adams, MS, LPC is required by law to maintain the privacy of your protected health information (PHI) and to provide you with notice of our legal duties and privacy practices with respect to PHI.

1. Who We Are

Becoming Her Counseling is a private therapy practice operated by Jerrica Adams, MS, LPC (Oklahoma LPC #11665), located at the Synergy Center for Wellbeing, 2202 E 49th St, Suite 410, Tulsa, Oklahoma 74105. We are a HIPAA-covered entity.

2. Information We Collect

Protected Health Information (PHI)

In the course of providing therapy services, we may collect and maintain information including your name, contact information, date of birth, insurance information, diagnosis and treatment records, session notes, and billing information.

Website Contact Form

When you submit a message through our website contact form, we collect your name, email address, phone number (if provided), and the contents of your message. We strongly advise against including any sensitive health information in website contact forms, as these are not end-to-end encrypted. This data is processed through third-party services (EmailJS and/or Formspree) and transmitted to our email inbox.

Website Analytics

Our website may collect anonymous browsing data including pages visited, time on site, and geographic region. This data is aggregated and non-identifiable. No PHI is collected through website analytics.

3. How We Use Your Information

We use your protected health information for the following purposes:

Treatment: To provide, coordinate, and manage your mental health care
Payment: To bill your insurance company or process your payment
Healthcare Operations: For quality assurance, practice management, and supervision purposes
Legal compliance: As required by state and federal law

4. How We Protect Your Information

All clinical records are maintained through SimplePractice, a HIPAA-compliant electronic health record (EHR) and virtual session platform. SimplePractice maintains a Business Associate Agreement (BAA) with our practice and uses industry-standard encryption to protect your data.

Virtual sessions are conducted through a HIPAA-compliant video platform. Sessions are never recorded without explicit written consent.

5. When We May Share Your Information

We will NOT share your health information with anyone without your written authorization, except in the following limited circumstances required by law:

Imminent danger: If you present a serious and imminent threat of harm to yourself or another identifiable person, we may disclose information to prevent that harm
Child or elder abuse: If we have reasonable cause to believe that a child, elder, or dependent adult is being abused or neglected, we are required by Oklahoma law to report this to the appropriate authorities
Court order: If compelled by a valid court order or legal process
Medical emergency: In a medical emergency to treat you

We will always try to discuss mandatory disclosures with you first whenever it is safe and appropriate to do so.

6. Your Rights

You have the following rights regarding your protected health information:

Right to Access: You have the right to inspect and copy your health information
Right to Amend: You have the right to request amendment of your health information
Right to an Accounting: You have the right to receive a list of certain disclosures we have made of your health information
Right to Restrict: You have the right to request restrictions on how your information is used or disclosed
Right to Confidential Communications: You have the right to request that we communicate with you in a specific way
Right to a Copy of This Notice: You may request a paper copy of this notice at any time

7. Confidentiality of Substance Use Disorder Records

If applicable, records related to substance use disorder treatment are protected by additional federal regulations (42 CFR Part 2) and may not be disclosed without your specific written consent, except in limited circumstances.

8. Minors

For clients who are minors (under 18), a parent or legal guardian must consent to treatment. However, in accordance with Oklahoma law, we maintain certain confidentiality protections for minor clients, particularly regarding sensitive health topics. We will discuss the specifics of confidentiality with both minors and their guardians at the start of treatment.

9. Website Cookies & Tracking

Our website does not currently use advertising cookies or tracking pixels. We do not sell, share, or monetize any visitor data. The website may use basic analytics to understand traffic patterns in an aggregated, non-identifiable way.

10. Third-Party Services

This website uses the following third-party services for functionality:

SimplePractice: HIPAA-compliant scheduling, billing, and virtual session platform
EmailJS / Formspree: Contact form email delivery (do not submit PHI through these forms)
Google Fonts: Typography (anonymized font loading)
Google Maps: Location display on contact page
Netlify: Website hosting (privacy policy at netlify.com/privacy)

11. Changes to This Notice

We reserve the right to change this notice. Changes will apply to all PHI we maintain. The current version of this notice is always available on our website and upon request.

12. Complaints

If you believe your privacy rights have been violated, you may file a complaint with our practice or with the U.S. Department of Health and Human Services Office for Civil Rights at www.hhs.gov/ocr. You will not be penalized for filing a complaint.
